The Ohio Pork Council has spearheaded a coalition of 11 agricultural groups to intervene in a lawsuit against the U.S. Environmental Protection Agency (EPA), filed by the Environmental Law and Policy Center (ELPC) on May 1, 2024. ELPC claims that the Total Maximum Daily Load (TMDL) for nutrients, particularly phosphorus, in the Maumee Watershed is insufficient to meet water quality standards, pushing for stricter limits on farmers.
This marks ELPC’s third lawsuit concerning the Western Lake Erie Basin. The agricultural groups, including the Ohio Pork Council, argue that these lawsuits are unscientific and baseless, asserting that Ohio farmers adhere to best practices for nutrient management. Cheryl Day, Executive Vice President of the Ohio Pork Council, emphasized the need to rely on factual, science-based regulations rather than costly legal disputes. Following the federal government’s response to the litigation, the coalition filed a Motion to Intervene on September 20.
